Don't Get Tricked: Halloween Tips to Avoid Estate Planning Pitfalls

The Scariest Thing in Your House Isn't a Ghost

This time of year, we watch scary movies, decorate with skeletons, carve pumpkins, and jump at every creak in the floorboards. But here's what scares us most isn’t a goblin, ghoul, or any other monster that goes bump in the night. It’s an estate plan that hasn't been updated since your last major life event.

Trick-or-treating is fun. Estate planning tricks? Not so fun, and most people never check for them until it's too late.

Think of your estate plan like a haunted house. Every room holds a surprise — and none of them are good. Let's walk through it together, flashlight in hand, so you can find those surprises before they find you.

Trick #1: Your will is stuck in the past

Marriage, divorce, a new baby, a grandchild, a move to another state — each of these should trigger a fresh look at your will and trust. It's the most important estate planning tip we give families: review your plan every time life changes.

That "set it and forget it" will from 2010 probably doesn't match your 2026 reality. A haunted house that hasn't been touched in years collects cobwebs. Your will shouldn't collect them either.

Trick #2: Beneficiaries — where mistakes hide in the dark

Your Estate Plan names who gets your assets. But assets like life insurance policies and retirement accounts pass outside the Estate Plan, straight to whoever is listed as the beneficiary on the account. If you remarried, had another child, or lost someone you'd named years ago, those forms may still whisper an old name.

This is one of the most common estate planning mistakes we see. Updating your Estate Plan matters — but so does updating every beneficiary form. Don't let an old name haunt your family's future.

Trick #3: Your assets aren’t actually in your trust

A lot of families set up a revocable living trust to avoid probate, then never finish the job. Your trust is only as strong as the assets it holds. If you bought a house after creating your trust — or just never changed the title — that home may still be in your name alone, which means it could still go through probate.

You wouldn't leave your front door unlocked on Halloween night. Don't leave your biggest asset unprotected either.

Trick #4: Your named guardian is a ghost from the past

If you have young children, your plan names someone to care for them if something happens to you. That's a beautiful decision — but it can quietly go stale. The guardian you chose ten years ago may live in another state now, or your relationship may have changed.

Estate planning isn't a one-time event. It's a living document that should reflect the people you trust today — not the ones you trusted a decade ago.

Trick #5: Your business is unprotected

If you've started a business, your estate plan needs to cover it. Who takes over? Who manages it? What happens to your ownership if you can't run it? Without a succession plan, a business you spent years building can get tangled up in court — or worse, end up in the wrong hands.

Because here's the thing: a business left without a plan is a lot like Frankenstein's monster. It was stitched together from your hard work, your sleepless nights, and every decision you made along the way — but once you're gone, nobody knows how to keep it alive. It stumbles forward, everyone screams, and it can end up in pieces. That's a nightmare no one should sign up for.

Trick #6: Your plan is invisible — and nobody can find it

Even a well-drafted plan is useless if nobody can find it. It might as well be the Invisible Man — technically there, but completely out of sight. Keep your documents somewhere your family or executor can access, and make sure at least one trusted person knows where everything lives. Digital copies, a safe deposit box, a folder in your desk — whatever works, as long as it's not a secret hidden in the attic.

Because a plan nobody can find is a plan nobody can use. It only turns visible when it's too late — usually right when your family needs it most, and it's nowhere to be seen. Don't let the one document that matters be the one that vanishes.

Don't Let Your Estate Be the Real Horror Story

Estate planning is about peace of mind. It's about making sure the people you love are protected, no matter what life throws your way. And the best way to avoid the tricks is simple: review your plan, update it when life changes, and work with a team who knows the law in your state.

This Halloween, the only scary thing should be the decorations. Your estate plan? It should feel like a safe, well-lit home.
